End User License Agreement & Terms of Use

Effective date: August 21, 2026

These Terms of Use (the “Terms”) govern your access to and use of the Lift Aero Partners client platform at liftaero.ca, including its related notifications and services (together, the “Platform”). The Platform is operated by Lift Aero Partners Inc. of Edmonton, Alberta, Canada (“Lift Aero”, “we”, “us”). By signing in to or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

The Platform is a tool for managing flight operations, scheduling, billing, and related records. It does not itself provide air transportation. Any charter, management, or other aviation services remain governed by the separate agreements covering those services; these Terms govern the Platform only.

1. Accounts and eligibility

Platform accounts are created and authorized by Lift Aero for its customers, passengers, crew, and staff. You may use the Platform only with an account issued to you, or under delegated access that Lift Aero has configured for you. You are responsible for keeping your password, passkeys, and verification codes confidential and for all activity under your account. Notify us promptly at info@liftaero.ca if you believe your account has been compromised.

2. License

Subject to these Terms, Lift Aero grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for its intended purpose: managing and viewing flights, documents, invoices, and records connected to your relationship with Lift Aero. No other rights are granted. We may suspend or revoke this license at any time, including when your relationship with Lift Aero ends.

3. Acceptable use

You agree that you will not:

  • access or attempt to access data or accounts you are not authorized to view;
  • share your credentials or let anyone else use your account;
  • probe, scan, or test the Platform’s security, or interfere with its operation or infrastructure;
  • scrape, harvest, or bulk-download Platform content by automated means;
  • upload content that is unlawful, malicious, or that infringes another’s rights; or
  • use the Platform for any purpose other than its intended operational use.

4. Your content

You (or the account you belong to) retain ownership of the documents and information you submit to the Platform, such as travel documents, licences, receipts, and notes. You grant Lift Aero a license to store, process, and share that content as needed to operate the Platform and deliver our services — for example, preparing manifests, meeting regulatory and customs requirements, and issuing invoices. You are responsible for the accuracy of the information you provide; inaccurate travel or licensing information can affect flights operated for you. Our handling of personal information is described in the Privacy Policy.

5. Operational information disclaimer

The Platform presents operational information — including schedules, itineraries, weather, aircraft position tracking, and flight and duty time calculations — as a planning and reference aid only. This information may be delayed, incomplete, or inaccurate, and position data is sourced from third parties. It is not a substitute for official aeronautical information sources, air traffic services, or the independent obligations of the operator, dispatchers, and pilot-in-command under the Canadian Aviation Regulations and other applicable law. Do not rely on the Platform as a sole source for any safety-of-flight decision.

6. Billing and invoices

Invoices presented through the Platform may be issued by Lift Aero Partners Inc. or by an affiliated billing company identified on the invoice (such as Great Circle Aviation Inc.). The invoice document itself, and the agreement under which the services were provided, govern payment terms. The Platform does not store your payment card or bank account numbers.

7. Third-party services

The Platform relies on third-party providers (for example for hosting, email, SMS, flight tracking, and accounting integration) and may link to external sites and apps such as mapping or flight-planning tools. Those services are governed by their own terms, and we are not responsible for their content or availability.

8. Intellectual property

The Platform, including its software, design, logos, and content we create, is owned by Lift Aero or its licensors and is protected by intellectual property laws. Except for the limited license in Section 2, nothing in these Terms transfers any rights to you.

9. Availability and changes

We may modify, suspend, or discontinue any part of the Platform at any time, with or without notice, including for maintenance and upgrades. We work to keep the Platform available and accurate but do not guarantee uninterrupted or error-free operation.

10. Disclaimer of warranties

The Platform is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, and non-infringement, to the maximum extent permitted by law.

11. Limitation of liability

To the maximum extent permitted by law, Lift Aero and its directors, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising out of or related to your use of (or inability to use) the Platform. Our total liability for any claim relating to the Platform is limited to CAD $100. Nothing in these Terms limits liability that cannot be limited under applicable law, and nothing in these Terms limits or modifies any rights or obligations under a separate charter or services agreement between you and Lift Aero.

12. Suspension and termination

We may suspend or terminate your access to the Platform at any time, including for breach of these Terms or when your relationship with Lift Aero ends. Sections that by their nature should survive termination (including Sections 4, 8, 10, 11, and 13) survive. Records retained after termination are handled as described in the Privacy Policy.

13. Governing law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts of Alberta for any dispute relating to these Terms or the Platform.

14. Changes to these Terms

We may update these Terms from time to time. The effective date above reflects the latest revision, and material changes will be communicated through the Platform or by email. Continued use of the Platform after a change takes effect constitutes acceptance of the updated Terms.

15. Contact

Questions about these Terms can be sent to info@liftaero.ca or to Lift Aero Partners Inc., 3112 Watson Green SW, Edmonton, Alberta T6W 0P2, Canada.
